Boyer & Lienard's (B&L's) model of obsessive-compulsive disorder (OCD) rituals does not completely conform to our clinical experience with patients, and the clinical implications of their model is not described by the authors. We discuss potential differences of opinion regarding both the nature of OCD and the mechanisms involved in the maintenance of symptoms, and how emotional processing theories can account for treatment effects. Yet the individualistic methodology of Catholic bioethics inherited from the manualist tradition has yet to incorporate this critical component of the Catholic moral tradition. Software piracy is an instance of unauthorized duplication of information goods where laws and norms are not agreed-upon. This article presents a content analysis of articles from the five highest circulating U.S. newspapers 1989-2004 as evidence of the prevailing social environment surrounding software piracy. The rationales in the news articles are analyzed as evidence of the social and psychological underpinnings of attitudes toward software piracy. An expanded version of Sykes and Matza's (American Sociological Review 22, 664-670, 1957); Zamoon and Curley (...) (Working paper, Kuwait University, Kuwait, 2007) neutralization framework is applied to analyze the content of the articles. We found that rationales condoning piracy showed a more balanced use of neutralization approaches, and less moral intensity toward the behavior. In contrast, rationales condemning piracy mostly promoted the injury aspect of software piracy, and suggested higher moral intensity. The discrepancies have practical implications as a barrier to the ability to connect the two sides of the debate concerning software piracy. (shrink)

Much of its incisive analysis owes to the editor's preface, introductory chapter, and concluding critical discussion of the positions represented, including his own.Four chapters lay out the Christian arguments for just war, biblical pacifism, and the late Glen Stassen's "just peacemaking theory," presenting ten practices to deter or transform violent conflict. Although Gushee's chapter would have to be placed among just war theorists, he stresses that war must be a last resort to defend innocent life, carried out with the least violence possible. Gushee appreciates the paradox of expressing love through acts of violence. Lisa Sharon Harper insists this goes beyond paradox to outright denial of the redemption Jesus brings, failing to honor the image of God in all persons. Following Anglican theologian Oliver O'Donovan, Erik Patterson sees publicly authorized force to protect society as a positive Christian duty. Striving to unite these two sides in practice, Stassen derives alternative, nonviolent strategies from the Sermon on the Mount to transform conflict at the local, national, regional, and international levels.But are such efforts successful? Can and do Christian peacemakers actually bring about significant societal and political change? Reconciling love may define kingdom discipleship, but when do we gauge love-in-action by the "present" reality of the kingdom, and when by the "not yet"? In his paper, “Was He Trying to Whistle It,” P. M. S. Hacker argues that the weight of what he terms the “internal” and “external” evidence shows that the kind of interpretation of the Tractatus put forth by Cora Diamond is wrong. The internal evidence is the Tractatus itself, while the external evidence consists of some of Wittgenstein’s other philosophical writings, letters, and records of his discussions about the book. This paper critically examines the way Hacker uses some ofthe external (...) evidence in building his case against Diamond and those sympathetic to her approach to the Tractatus. The main goal is not so much to defend the views that Hacker wants to attack, but to argue that given the nature of those views, the manner in which he attempts to use certain pieces of evidence against them is seriously misguided. Lisa Cahill's Love Your Enemies: Discipleship, Pacifism and Just War Theory provides an excellent introduction to questions of peace-making and war-making in the history of Western Christianity. Cahill canvasses the standard sources for her history: the generally pacifist period of the New Testament and the early church (chapters two and three); the emergence of the just war tradition with Augustine and Aquinas (chapters four and five); just war, crusade, and pacifist responses during the Reformation period (chapters six through eight); and just war and pacifist responses in the twentieth -century American debate (chapters nine and ten). Love Your Enemies is relatively comprehensive, even-handed, and well-written. Beyond its general competence, Love Your Enemies provides rich theological fare, situating questions on war and peace in the context of Christian discipleship as a whole. One result of using discipleship as the organizing motif is that pacifism gets an unusually sympathetic and fair hearing. Cahill serves as an excellent reporter on these contentious questions. While often intimating her sympathies, she consistently avoids taking decisive positions or closing avenues of exploration. The title of her final chapter -the "Fragility of the Gospel"-reflects this approach. In this chapter Cahill emphasizes that Christian communities must continuously challenge themselves and their society to live out the gospel of peace (239-44). BOOK REVIEWS 323 What does it mean to live as a follower of Jesus today (ix)? This is Cahill's central question. To this end she asks two further questions. First, what is the way of discipleship established by Jesus with regard to doing violence? Second, to what extent can Christians hope to apply this ethic of discipleship to the wider civil society (40)? These questions arise in a variety of forms throughout the book. For instance, Cahill elegantly shows how a Christian's eschatological commitments (i.e., beliefs about the extent to which God's peaceful rule can be established by a community of believers and/or the extent to which this can be realized in "the world") can affect her response to the possibility of doing violence. While setting as one's task the attempt to find a way to combine Christian discipleship with public responsibility has many strengths, it is not without possible pitfalls. Typically, "Christian responsibility" is contrasted with "the evangelical imperative of non-violence" (see 55-56). But this notion of "responsibility" often begs the central question-i.e., for the Christian, can the most "responsible" stance be anything but what Cahill proclaims to be the evangelical stance of non-violence? While Cahill does acknowledge the strength of the argument by advocates of "responsibility" (i.e., those ~ho set up the non-violent stance in opposition to the faithful following of Jesus), she does not explicitly endorse their move. Chapter 3 an· alyzes the Instructions, and 4 compares this to the regulations of the American Department of Health, Education, and Welfare (1979), the American College of Obstetricians and Gynecologists (1983), the American Fertility Society (1986), the British Medical Resarch Council (1982), the British Medical Association (1982) the Warmock Report (1984), the Australian National Health and Medical Research Council (1982) and the Victoria Government Committee (1982, 1983, 1984). Chapter 5 reports American reactions including those of Cardinal Bernadin and Archbishop Daniel E. Pilarczyk, theologians Richard A. McCormick, S.J. and James T. Burtchaell, C.S.C., and the columnist Charles Krauthammer. In Chapter 6 the authors draw their own conclusion. They think the Instruction has performed a service in calling attention to the need to set reasonable limits on the use of reproductive technologies, but they believe " The Vatican's call for legal prohibition of all reproduction technologies that eliminate sexual intercourse extends further than is morally necessary" (p. 138). They show, correctly, Humanae Vitae's principle of the inseparability of the unitive and procreative meaning of the marital act is the guiding principle by which the Instruction limits technological reproduction, but they reject this principle and propose in its stead that it is " the committed love relationship of the couple in its totality that gives the moral texture both to their sexuality and to their subsequent role as parents ", since " it is from the wholeness of the relationship that their specific physical acts of sex and 154 BOOK REVIEWS conception take their moral purpose. " Hence they would only exclude technologies that use gametes from donors other than the married couple. They omit discussion of another important principle proposed by the Instruction, namely the right of the child to be born of legitimate parents in a normal manner. They themselves seem to admit that the principle they propose to limit permissable techniques is not very helpful since after excluding donor methods they add, " although the authors recognize that further discussion may be necessary to clarify this point" (p. 138). In fact, couples consenting to insemination of the woman with a donor's sperm or contracting with a surrogate mother can easily justify their action as contributing to the wholeness of their loving relationship. Theologians who use this principle without further specification are logically forced to accept homosexual marriages and the artificial production of children for such marriages. This book simply ignores such obvious objections to their proposal. Indeed it does not seriously address in any detail the problem which the Instruction faces frankly and honestly, namely, what kind of reproductive acts are consistent with the totality of a committed loving relationship. Certainly, as the authors admit, some kinds of acts are not consistent with such a relationship, but they do not show critically how the principle they want to substitute for that of the Instruction can determine which reproductive technologies are not morally acceptable. The Instruction, on the contrary, took the necessary responsibility of proposing such a specification, by defining the structure of the marital act which is essential to this relationship. This does not mean that it defines it merely in its physical character, but in its specifying moral intention (its moral object) as an act which keps intact the intrinsic relation between the expression of love and the transmission of life. Gordon Baker and I had been colleagues at St John’s for almost ten years when we resolved, in 1976, to undertake the task of writing a commentary on Wittgenstein’s Philosophical Investigations. We had been talking about Wittgenstein since 1969, and when we cooperated in writing a long critical notice on the Philosophical Grammar in 1975, we found that working together was mutually instructive, intellectually stimulating and great fun. We thought that we still had much to say about Wittgenstein’s philosophy, and (...) it seemed to us that misinterpretations of passages in the Investigations were so extensive that it would be worth trying to write a detailed analytical commentary. It is difficult to recapture the excitement of those early days in being among the first to work on the microfilms and, subsequently, on the photocopies of Wittgenstein’s Nachlass. We spent many hundreds of hours poring over the typescripts and the often only semi-legible manuscripts, fascinated and privileged to be able to try to follow the development of the thoughts of a great philosophical genius. We talked endlessly about what we had found in Wittgenstein’s manuscripts and typescripts, and debated how it should be understood. The first fruit of our labours was Wittgenstein – Understanding and Meaning. Its guiding idea was to draw attention to the manner in which Wittgenstein linked the concepts of meaning, understanding and explanation, and so to bypass the connections between meaning, truth and truth-conditions that so fascinated philosophers of the 1970s, and to abandon the red-herring of assertion-conditions and anti-realism. After a hiatus of four years, during which time we wrote a controversial book entitled Frege – Logical Excavations and a polemical book on contemporary philosophy of language – Language, Sense. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 155 Humanae Vitae: A Generation Later. By JANET SMITH. Washington, D.C.: The Catholic University of America Press, 1991. Pp. xvi + 425. $42.95 hardcover; $17.95 paper. This is an ambitious and important study. I will first offer an overview of the volume to indicate its scope and note some of its major features. I will then respond briefly to some of the major criticisms Smith makes of (...) the argument against contraception advanced by Germain Grisez, Joseph Boyle, John Finnis, and myself. The work contains 8 chapters and 4 appendices. Chapters 3 and 4, as Smith says, "provide an analysis of Humanae Vitae itself and thus constitute the heart of the hook" (p. xi). Since this is so I will first summarize briefly Chapters 1, 2, 5, 6, 7, and 8 and then center atten· tion on the two central chapters and the four appendices. Chapters 1 and 2 provide the context for Humanae Vitae. The first chapter is devoted largely to an account of the so-called " Minority " and "Majority" documents of the Papal Commission for the Study of Problems of the Family, Population, and Birth Rate, while the second seeks to summarize Catholic teaching on Christian marriage prior to the encyclical. This summary draws principally from Pius XI's Casti Connubii and from nn. 47-52 of Vatican II's Gaudium et Spes. Smith takes up in some detail the issue of the" primacy" of procreation, concluding that Gaudium et Spes " seems to sidestep " this issue which, in her judgment, is irrelevant to the question of contraception. She thinks that this central document of Vatican II sent " mixed signals " on the question of contraception, although she believes that several passages " can very plausibly he read to support the position that contraception is portrayed as a violation not only of the procreative good of marriage hut also of the values of conjugal love" (p. 66). Chapter 5 deals with a wide range of theological issues: the biblical foundations for the teaching found in Humanae Vitae, the relevance of the concept of munus for this teaching, the possibility of acting " in good conscience " in a way contrary to its teaching, and the infallibility of the teaching. Of special value is the extended discussion of the con· cept expressed by the Latin term munus. Smith examines the rich meaning of this term in several magisterial documents, including Gaudium et Spes as well as Humanae Vitae. While a munus implies duties, it is essentially a noble, honor-bringing "gift" or "reward," signifying a vocation and sublime honor. Paul VI, in developing the integral vision of marriage in his encyclical, uses this concept to show that God, in giving to spouses the munus of handing on new life, has conferred on them the honor of sharing with him in the work of bring· 156 BOOK REVIEWS ing new life into the world. Smith shows beautifully how the rich theological meaning of this term helps " illuminate and enrich " the teaching of the encyclical. Chapters 6 and 7 investigate the arguments presented by dissenting theologians after Humanae Vitae to justify their repudiation of its teaching. In Chapter 6 Smith considers the views of Charles Curran and Bernard Haering, while in Chapter 7 she examines the proportionalist approach to moral issues developed by Joseph Fuchs, Richard McCormick and others. She provides intelligent criticism both of Curran and Haering and of proportionalist thought, focusing on the repudiation of specific moral absolutes. In Chapter 8 Smith provides a very helpful summary of Pope John Paul II's understanding of the human person, human sexuality and marriage. In particular, she takes up his notion that in marriage and in the act proper rto it man and woman make a " gift " of themselves to one another. Simultaneously to choose to give themselves to each other in the marital act and to contracept is then seen to involve an inner contradiction, a falsification of the " language of the body " (pp. 230258 ). Smith also takes up some of the major criticisms levelled against John Paul II's thought, in particular Lisa Sowle Cahill's, which charges him with an overromantic view of love and a failure to recognize that...
